Welcome to Hold This Moment LLC. By visiting our website or placing an order, you agree to the following Terms of Service. Please read them carefully before purchasing.
This website is operated by Hold This Moment LLC, an Iowa limited liability company based in Urbandale, Iowa. Throughout the site, the terms "we," "us," and "our" refer to Hold This Moment LLC. These Terms apply to all customers, visitors, and users of our website and in-person services.
By visiting, interacting with, or purchasing from us — whether online or at a farmers market or event — you agree to be bound by these Terms of Service and our Privacy Policy.
Access and Account
By using this website, you confirm that you are at least 18 years of age. If you are under 18, you may only use this site with the involvement and consent of a parent or legal guardian.
When placing an order, you agree to provide accurate, current, and complete information including your name, email address, payment information, shipping address, and order details. You are responsible for keeping your account information up to date.
Our Products
Hold This Moment LLC creates custom photo magnets made to order using photos submitted by the customer. Every magnet is handcrafted individually, which means slight variations in color, brightness, and cropping may occur depending on the photo submitted and the device used to view it.
All product descriptions, pricing, and availability are subject to change without notice. We reserve the right to discontinue products or limit quantities at our discretion.
In-Person Sales
Hold This Moment LLC operates at farmers markets and live events in the Des Moines, Iowa area. For in-person purchases:
- We review every photo with you before printing to ensure you are satisfied with the image quality and composition
- All in-person sales are final once the magnet has been pressed and accepted by the customer
- We are not responsible for photo quality concerns that were visible and approved at the time of production
Custom Photo Orders
Because every product is personalized using a photo submitted by you, each order is made specifically for that customer.
By placing an order you are responsible for:
- Submitting the correct photo, quantity, and order details
- Ensuring your photo is clear, well-lit, and high resolution
- Providing an accurate shipping address
We are not responsible for issues resulting from blurry, dark, low-resolution, cropped, or otherwise unsuitable photos submitted by the customer. If we notice a significant photo quality concern before production we will contact you before proceeding.
Photo Submission and Usage Rights
By submitting a photo to us, you confirm that:
- You are the owner of the photo or have legal permission to reproduce it
- The photo does not infringe on the rights of any third party
- The photo does not contain unlawful, offensive, or inappropriate content
You grant Hold This Moment LLC permission to use your submitted photo solely for the purpose of creating and fulfilling your order. We do not claim ownership of your photos and will not sell them.
Social media and marketing: If we would like to share a photo of your completed magnet on our social media or marketing materials, we will always ask for your explicit permission first. We will never share your personal photos without your consent.
We reserve the right to refuse any order containing content we determine to be unlawful, abusive, obscene, defamatory, or otherwise inappropriate.
Orders
When you place an order you are making an offer to purchase. We reserve the right to accept, decline, or cancel any order for any reason including suspected fraud, inappropriate content, pricing errors, or inability to fulfill the order.
Payment must be received and processed before production begins.
Because custom products are made to order, we may be unable to accommodate cancellations or changes once production has started. Please review your order carefully before submitting.
If we cancel an order after payment has been processed, a full refund will be issued within 5 business days.
Prices and Billing
All prices are listed in U.S. dollars and are subject to change without notice. The price charged will be the price in effect at the time your order is placed, as shown in your order confirmation.
You agree to provide accurate and complete payment information and represent that you are authorized to use the payment method provided.
Shipping and Delivery
All photo magnets are made to order. Please allow 3–5 business days for production before your order ships. Once shipped, standard delivery typically arrives within 3–7 business days. Total estimated delivery time is 6–12 business days from the date of your order.
You will receive a shipping confirmation email with tracking information once your order has shipped.
We are not responsible for carrier delays, weather delays, holiday delays, or lost packages once an order has been transferred to the carrier. Customers are responsible for providing a correct and complete shipping address. Orders shipped to an incorrect address provided by the customer are the customer's responsibility.
Local market orders: Hold This Moment LLC sells custom photo magnets in person at farmers markets and events in the Des Moines, Iowa area. In-person orders are made and delivered on the spot at the market — no shipping required for in-person purchases.
Returns, Refunds, and Replacements
Because our magnets are custom made using your photo, all orders are final sale and cannot be returned or exchanged.
If something goes wrong on our end: If your order arrives damaged, has a production defect, or we made an error, please contact us within 7 days of delivery at hello@holdthismoment.co with your order number and a clear photo of the issue. If the issue is approved, we will send a replacement or issue a full refund within 7 business days.
We are not responsible for quality issues caused by customer-submitted photos that are blurry, dark, low-resolution, cropped, or otherwise unsuitable.
Intellectual Property
All website content, branding, logos, product descriptions, images, graphics, and other materials created by Hold This Moment LLC are our property or used with permission. You may not copy, reproduce, distribute, or use our content without prior written permission.
Customer-submitted photos remain the property of the customer or the rightful owner.
Privacy
Your use of our website is subject to our Privacy Policy. Please review it to understand how your information is collected, used, and protected.
Prohibited Uses
You may not use our website or services to:
- Submit photos or content that you do not have the legal right to use
- Submit unlawful, abusive, threatening, obscene, or inappropriate content
- Provide false or misleading information
- Violate any applicable federal, state, or local laws
- Interfere with the security or functionality of our website
- Impersonate another person or entity
We reserve the right to refuse service or cancel orders that violate these Terms.
Disclaimer of Warranties
Our website and products are provided "as is" and "as available." We do not guarantee uninterrupted, error-free access to our website. Final product appearance including color, cropping, and brightness may vary from what appears on your screen depending on your device settings and the photo submitted.
Limitation of Liability
To the fullest extent permitted by law, Hold This Moment LLC is not liable for any indirect, incidental, or consequential damages arising from your use of our website, products, or services. Our total liability for any claim related to an order will not exceed the amount paid for that order.
Indemnification
You agree to indemnify and hold harmless Hold This Moment LLC from any claims, damages, or expenses arising from your breach of these Terms, your violation of any law, or your submission of photos or content you did not have the right to use.
Governing Law
These Terms are governed by the laws of the State of Iowa, United States. Any disputes shall be resolved in Dallas County, Iowa.
Changes to These Terms
We reserve the right to update these Terms at any time by posting changes on this page. Your continued use of our website after changes are posted constitutes acceptance of the updated Terms.
